S.T.O.P. Welcomes House Passage Of ‘4th Amendment Is Not For Sale’ Act

(New York, NY 4/18/24) – Today, the Surveillance Technology Oversight Project (S.T.O.P.), a New York-based privacy and civil rights group, welcomes the House of Representatives’ passage of the Fourth Amendment Is Not For Sale Act, which prohibits law enforcement and intelligence agencies from purchasing Americans’ personal data without a court order. First introduced in 2021, the bill has gained bipartisan support in Congress to close the loophole allowing police and intelligence agencies to circumvent the Constitution by buying access to sweeping social media, location, cell phone, and other sensitive information. The civil rights group called on the Senate and President Biden to pass the bill.

“"You can’t put a price on the Constitution, but that’s what law-enforcement does every day when they purchase our data to circumvent the courts,” said Surveillance Technology Oversight Project Executive Director Albert Fox Cahn. “This long overdue legislation would make clear that police can’t get more data than the Fourth Amendment allows by buying data rather than applying for a warrant. We call on the Senate and President Biden to move quickly to make this law.”

In February, S.T.O.P. condemned Speaker Mike Johnson for planning a rare secret session of the whole House to reauthorize Section 702 mass surveillance powers. Section 702 of the Foreign Intelligence Surveillance Act (FISA) grants sweeping surveillance powers that the FBI illegally abuses thousands of times per year to track U.S. citizens, despite hollow promises that the powers would only target foreign nationals.
